This contract is entered into date on_______ between (scrapbook
artist), Jessica Dunc and (client)______________. The total
cost of the project is estimated at $______. This includes $________
per (single-sided) scrapbooked page as well as the time and
materials involved in completing the project, and $_______ for
the cost of the album or frame.
A fifty percent deposit of the estimated cost is due at the time this agreement is signed, and the remaining fifty percent is due when the completed project is delivered. If the client is not in the Portland metropolitan area, they will be notified upon completion of their project, and it will be shipped within 24 hours of Remember The Moment's receipt of the final payment. Any photos or memorabilia that were not used in the completion of the project will be returned to the client upon delivery of the finished product.
If a completed project is being shipped to a client outside
the Portland metropolitan area, it will be sent through a reputable
delivery service (the United States Postal Service, United Parcel
Service, or Federal Express.) All shipments will be insured
for the cost of the project, and registered with proof of delivery
required. Remember The Moment is only responsible for the shipping
insurance, and in the event that a project is lost or damaged
during shipment, the Remember the Moment will be liable.
It is estimated that the project will be completed by (date)_______. Weekly updates on the project are available upon the client's request. Client is expected to clearly explain either verbally or in writing what he/she envisions for the project. Once the project is completed, the client will have the opportunity to review it and request revisions. However, revisions are performed only one time. If additional materials are needed for the revisions, the client is responsible for those costs, which must be paid in advance.
The scrapbook artist agrees to meet with the client prior to
initiating the project so the client may explain his/her vision
for the project. The initial consultation may last up to two
hours. If additional meetings are required to organize photos
and memorabilia, and/or to discuss the project, the client will
be charged on an hourly basis for the additional time. The client
must provide all personal photos and other memorabilia at the
initial meeting. Once the project is underway, the scrapbook
artist is not obligated to include additional photos or memorabilia
in the project. The client agrees to make copies of any one-of-a-kind
photos prior to turning them over to the scrapbook artist. The
scrapbook artist in turn agrees to practice due diligence in
handling and using the client's photos or memorabilia in the
project.
In the event that a client's photos or memorabilia are damaged by any unavoidable natural disaster or tragedy such as; fire, flood, earthquake, tornado, theft, auto accident, etc., while in the possession of Remember The Moment, the client will not hold Remember The Moment liable. However, Remember The Moment will be liable for the cost of reprinting the damaged photos from negatives, CDs, or digital memory cards.
All photos and memorabilia are mounted to the scrapbook page
or framed layout using permanent adhesive. Any items that the
client does not wish to have permanently mounted will be disclosed
to the scrapbook artist at the initial interview. They will
then be positioned in the project using photo-safe corners to
allow for safe removal of the photo at a later date.
All materials used in the creation of scrapbooks, and framed projects are labeled as "photo safe, archival quality, acid free, and/or lignin free" by the producing company. Therefore, any damage from defective products is not the liability of Remember The Moment.
Unless otherwise specified, photos and memorabilia may be cut/cropped or altered during the creative process. Any items that the client does not wish to have cut/cropped will be disclosed to the scrapbook artist at the initial interview.
By accepting the finished project, it is understood that the
client is satisfied with all of the work therein. If a project
has been shipped to the client and he/she is unsatisfied, they
may return it within 7 days of receipt so that Remember The
Moment may make the specified alterations. The client understands
that he/she is responsible for the cost of insuring and returning
the project to Remember The Moment for the modifications. All
sales are final. All returned checks are subject to a $25.00
fee. The outstanding balance must then be paid by cash or money
order within 7 days, or the client will be turned over to the
proper authorities.
The client's signature indicates that he/she understands and agrees to follow the requirements set forth by this contract.
